Lalewisedeal Ltd (“Lalewisedeal”, “we”, “us”, “our”) operates an online booking platform for accommodation services under the brand bestavailablerate.com.

2. DEFINITIONS

  • Accommodation Provider: The hotel or lodging operator offering accommodation services.

  • Guest / You: The person making a reservation through the website.

  • Platform: The Lalewisedeal website and related booking systems.

  • Booking: A reservation made via the Platform.

  • Commission: The fee payable by the Accommodation Provider to Lalewisedeal can be deducted from the paid amount or paid depending on the conditions of the contract with the Accommodation Provider by the Accommodation Provider.

  • Client Money: Funds collected from guests on behalf of Accommodation Providers.

3. OUR ROLE AS BOOKING AGENT

3.1 Disclosed Agent Status

Lalewisedeal acts solely as a disclosed booking agent.

We:

  • do not own or operate accommodation properties;

  • do not provide accommodation services;

  • do not act as the principal seller of accommodation.

All accommodation services are supplied directly by the Accommodation Provider. Lalewisedeal Ltd operates sloely as a booking agent for accommodation providers. Lalewisedeal Ltd does not own, manage or provide accommodation services and does not act as the principal seller of accommodation.  So, “Price charged by Hotel” and “Collected by Lalewisedeal as agent”, Payments made through the Lalewisedeal platform are collected by Lalewisedeal Ltd on behalf of the Accommodation Provider.

Lalewisedeal Ltd does not sell accommodation in its own name and does not charge VAT on accommodation prices.

3.2 Contractual Relationship

When you make a booking:

  • a direct contract is formed between you and the Accommodation Provider;

  • Lalewisedeal is not a party to that accommodation contract.

  • The contract for accommodation is concluded directly between the guest and the accommodation provider.

4. BOOKINGS

4.1 Booking Process

By completing a booking, you confirm that:

  • all information provided is accurate;

  • you are authorised to use the payment method;

  • you accept these Terms and Conditions.

4.2 Booking Confirmation

A booking is confirmed when:

  • payment has been successfully received; and

  • a confirmation email is issued.

5. PRICES AND PAYMENTS

5.1 Prices

Accommodation prices are:

  • set solely by the Accommodation Provider;

  • inclusive or exclusive of taxes as determined by the provider.

5.2 Payment Collection

Payments are collected by Lalewisedeal Ltd acting as agent on behalf of the Accommodation Provider.

Amounts collected:

  • constitute client money;

  • do not represent Lalewisedeal revenue.

5.3 Payment Methods

Payments may be processed via third-party payment processors including Stripe, PayPal and Wise.

We do not store full card details.

6. VAT, TAXES & INVOICES

6.1 VAT Treatment

  • Lalewisedeal does not charge VAT on accommodation prices.

  • VAT (if applicable) is determined by the Accommodation Provider based on local law.

6.2 Invoices

  • Lalewisedeal does not issue VAT invoices for accommodation.

  • Guests requesting invoices must contact the Accommodation Provider directly.

6.3 Receipts

Lalewisedeal may provide payment receipts, which:

  • confirm payment collection only;

  • are not tax invoices.

7. COMMISSION STRUCTURE

Lalewisedeal earns revenue solely through commission paid by Accommodation Providers.

Guests do not pay commission to Lalewisedeal.

8. CANCELLATIONS, MODIFICATIONS & REFUNDS

8.1 Accommodation Provider Policies

Cancellation, modification and refund rules are determined by the Accommodation Provider.

These policies are displayed during the booking process.

8.2 Refund Processing

Where applicable:

  • refunds are authorised by the Accommodation Provider;

  • Lalewisedeal processes refunds strictly on the provider’s instruction.

  • Once your refund is authorised by the Accommodation Provider, we will send you an email to notify you of the approval or rejection of your refund

8.3 Late or missing refunds

If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us at info@bestavailablerate.com.

9. GUEST OBLIGATIONS

Guests agree to:

  • comply with property rules;

  • behave lawfully and respectfully;

  • pay applicable local taxes directly to the provider if required.

10. ACCOMMODATION PROVIDER RESPONSIBILITIES

Accommodation Providers are solely responsible for:

  • delivering accommodation services;

  • property condition and safety;

  • compliance with local regulations;

  • tax reporting and guest invoicing.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Lalewisedeal shall not be liable for acts or omissions of Accommodation Providers;

  • we are not responsible for service quality, overbooking, closures, or force majeure events.

Nothing in these Terms limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation.

12. CONSUMER RIGHTS (EU)

Nothing in these Terms affects your statutory rights under:

  • EU Consumer Rights Directive (2011/83/EU);

  • Irish consumer protection law.

13. FORCE MAJEURE

Neither party shall be liable for failure to perform due to events beyond reasonable control including natural disasters, strikes, government actions, pandemics or system outages.

14. DATA PROTECTION (GDPR)

Personal data is processed in accordance with:

  • Regulation (EU) 2016/679 (GDPR);

  • Irish Data Protection Act 2018.

15. INTELLECTUAL PROPERTY

All website content, trademarks and software remain the property of Lalewisedeal Ltd or its licensors.

Unauthorised use is prohibited.

16. MODIFICATIONS TO TERMS

We may update these Terms periodically.

The version published on the website at the time of booking shall apply.

17. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Ireland.

The courts of Ireland shall have exclusive jurisdiction.
